Frequently Asked Questions About Auto Insurance Claims

We always want the best things for ourselves when we purchase anything and auto insurance is not an exception.  There are a lot of things we want to know before purchasing an auto insurance premium. Often, there are even more questions when an accident has happened and you have to fill a claim. There are six most common questions that customers ask when they are filling a claim.


1. How do I know the vehicle’s value? What if my insurance company is not paying me fairly on my loss? Normally, book value and dealer quotes are considered to establish a vehicle’s value. If either you or your insurance company disagrees on those quotes, the value of your vehicle can be determined by comparing to similar vehicles available at the market. The mileage and condition of your vehicle will be considered when determining the value of your vehicle.

2. My auto insurance company denied paying 100 percent of my damages on a liability claim. What can I do? In such case you can address the issue to the Department if Insurance, Financial Institutions and Professional Registration. They will be able to determine whether the insurance company conducted a complete investigation prior making the decision on how much loss is going to be covered. However, if you do not agree with the amount you will have to go to court.

3. Does the insurance company have to pay for a rental car on my liability claim? Not, necessarily. If you do not have another vehicle available, the insurance company can cover the cost of a rental car as part of your damages from the accident. At the same time there is no insurance statutes exist on this issue and a lot will depend on your insurer. It is good to ask this question before purchasing your policy.


4. Is it ok for an insurer to estimate costs using parts that are not made by the original manufacturer or salvage parts? Yes, it is ok. An insurer has to return the vehicle to its condition before the accident, so they do not have to put new parts on the used vehicle.

5. I have written two estimates and submitted them to the insurance company. My insurer revised them and paid me based on the revised estimate. Is such action legal? Yes, it is legal, as long as the insurance company covers proper reparation of your vehicle.

6. Can the insurer tell me where I have to repair my vehicle? Yes, they can. Your insurance company has to guarantee that the work will be done well and your vehicle will be returned to its condition before the damage, but they can choose where you have to repair your car. At the same time, you can decide to use a different shop, but you will have to cover any additional costs.
